Terms of Sale

Last updated 29 July 2026 · Draft pending legal review

Note to the reader. This document was drafted with care but not by a lawyer. It is built on EU consumer law and Portuguese law as they apply to a Lisbon-based seller. Have it reviewed before the first sale — particularly sections 6 and 11, where getting the wording wrong costs real money.

1. Who you are buying from

HIGHER.BOUTIQUE is operated by TOTEHM, established in Lisbon, Portugal. Contact: hello@higher.boutique.

These terms apply to every order placed on higher.boutique. By completing checkout you accept them. Placing an order forms a contract between you and us — not between you and our printing partner, our artists, or our workshops.

2. What a Totehm Cloth is

A Totehm Cloth Streetwear is a garment made to order and carrying an original artwork generated from a text you supply — a sentence you write, or a chapter of the Book your Totehm has written on totehm.com.

Each piece receives a Totehm Cloth Name in the form 1.YourName, where the number is the current TOTEHM epoch year. That name is unique and permanent. It is how the piece is later found through Decode.

3. The artwork is a surprise — read this before you pay

You will not see the artwork before it is produced and shipped. This is not an oversight, it is the product. You choose an Artistic Style; our artists then curate the final artwork from your text, and it is revealed to you when you unbox the piece.

Because you accept this at checkout, the finished artwork not matching what you imagined is not a defect and is not grounds for return. A manufacturing fault, a wrong size shipped, or damage in transit are — see section 7.

Artistic Styles rotate. Each is available for a limited time and a limited number of pieces. Once a Style closes, it does not return.

4. Your text, and what we do with it

You keep ownership of the text you submit. By submitting it you grant us a non-exclusive, worldwide licence to reproduce it on your piece, to use it as input for artwork generation, and to store it so Decode can display it.

We keep ownership of the resulting artwork and of the TOTEHM marks on the piece. You own the physical garment and may wear, photograph, gift or resell it. You may not reproduce the artwork commercially.

Decode is public

Decode lets anyone look up a piece by its Totehm Cloth Name and read the text behind it. That is the point of it — the piece is a time capsule. Do not submit anything you would not want read by a stranger. You can ask us to remove your text from Decode at any time by writing to us; the piece itself is unaffected.

What we will refuse

We may decline any order, before or after payment, whose text is unlawful, hateful, harassing, sexual involving minors, or which infringes someone else's rights. A declined order is refunded in full. We are not obliged to explain our reasoning beyond the category.

5. Prices, payment and taxes

6. Your right to change your mind

EU law gives consumers 14 days to withdraw from a distance purchase. That right does not apply to goods made to your specifications or clearly personalised (Directive 2011/83/EU, Article 16(c)).

Every Totehm Cloth is made to order and carries an artwork generated from your own text. By confirming your order you accept that your right of withdrawal is lost once production begins.

Before production begins, you may cancel for a full refund. In practice that is a short window — write to us immediately and we will stop it if we still can.

This changes nothing about your legal rights if something is actually wrong with the piece. Those are in the next section and cannot be waived.

7. If something is wrong with your piece

You have the legal guarantee of conformity. Under Portuguese law (Decreto-Lei 84/2021) this runs for three years from delivery for physical goods — longer than the two-year EU minimum.

Tell us within a reasonable time of noticing, with photographs. If the piece is faulty, the wrong size was shipped, or it arrived damaged, we will repair, replace or refund it at no cost to you. We pay return shipping in those cases.

8. Production and delivery

Pieces are produced on demand by our printing partner and shipped directly from their facility. Production typically takes a few working days before shipping; the carrier's transit time is on top of that. Any date we give is an estimate, not a guarantee.

Risk passes to you on delivery. If a parcel is lost in transit, that is ours to resolve, not yours — tell us and we will replace it or refund it.

Check your address at checkout. A parcel returned to us because the address was wrong can be reshipped at your cost.

9. The Luxury service — totehmizing a piece you already own

This service applies our work to an object you already own. It is sold separately from the boutique and works differently:

Customisation is irreversible. Some materials cannot be treated at all, and we will refuse them rather than risk your piece.

The quote states a maximum liability figure for accidental damage. You approve that figure before work begins. Beyond it, we are not liable.

We are not affiliated with, endorsed by, or acting on behalf of the maker of your piece. Customising it will void that maker's own warranty and will usually reduce its resale value. That is your decision to make, and you make it knowingly.

10. Your account and your data

Your orders are tied to the email you sign in with. Sign-in uses one-time codes; there is no password. What we store, who we send it to, and how to have it erased is set out in our privacy terms on totehm.com.

11. Limits, and what we do not limit

We are liable for what we actually caused: a faulty piece, a lost parcel, an order we mishandled. Our total liability for any order is capped at what you paid for it, except for the Luxury service where the quote's figure applies.

We are not liable for indirect loss, and not for delays caused by carriers, customs, or events outside our control.

Nothing here limits your rights as a consumer under EU or Portuguese law where those rights cannot be limited by contract. Where a clause conflicts with them, the law wins and the rest of these terms stand.

12. Disagreements

Write to us first — hello@higher.boutique. Almost everything is solved that way.

If it is not, these terms are governed by Portuguese law. As an EU consumer you keep the protection of your own country's mandatory rules and may bring proceedings there. You may also use the EU Online Dispute Resolution platform.

13. Changes

We may update these terms. The version that applies to your order is the one published when you placed it. Material changes will be flagged before they take effect.
